By accessing or using Starts Now's AI chatbot platform and related services, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you must not access or use our services. These terms apply to all visitors, users, and others who access or use our services.
2. Description of Service
Starts Now provides an AI-powered chatbot platform that allows users to create, train, and embed intelligent chatbots on their websites. Our service includes website crawling, content processing, AI training using third-party AI providers, chatbot embedding, analytics, and related features as described on our website.
3. User Accounts
To use our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and promptly update it as necessary. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these terms. You must not use our services to violate any laws, infringe on intellectual property rights, distribute malware or harmful code, engage in unauthorized data collection, or transmit any content that is defamatory, obscene, or otherwise objectionable.
5. Intellectual Property
Our platform, including its code, design, and technology, is owned by Starts Now and protected by intellectual property laws. You retain ownership of the content you provide, including your website content used for chatbot training. By using our services, you grant us a license to process, store, and use your content solely for the purpose of providing and improving our services.
6. Service Limitations
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We are not liable for any damages resulting from service interruptions, data loss, or any other issues arising from the use of our platform.
7. Fees and Payments
Paid plans require payment of fees. Billing is handled manually via Payoneer invoice: after you request a plan, our team sends an invoice and activates the plan once payment is confirmed. All fees are non-refundable unless otherwise stated. We may change our pricing with notice. You are responsible for all taxes associated with your use of our services. Failure to pay fees may result in suspension or termination of your account.
8. Third-Party Services
Our platform relies on third-party services including Google Gemini for AI embeddings and responses, Supabase for data storage and authentication, Upstash for rate limiting, and Payoneer for payment processing. Your use of these services is subject to their respective terms and policies. We are not responsible for the actions or omissions of third-party service providers.
9. Limitation of Liability
To the maximum extent permitted by law, Starts Now shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claims under these terms shall not exceed the amount you have paid us in the twelve months preceding the claim.
10. Termination
We may terminate or suspend your account and access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services will immediately cease. You may terminate your account at any time by contacting us. Provisions regarding intellectual property, limitation of liability, and governing law will survive termination.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of material changes by posting the updated terms on our website and, where appropriate, by email notification. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved exclusively in the courts of San Francisco County, California.
